Privacy Policy

The Privacy Policy contains information on how Intersnack Poland Sp. z o.o. – the owner of the www.intersnack.plwebsite  (the "Website") – processes information about the Website users (the "Users"). The Policy fulfils the information obligation resulting from the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27.04.2016 – General Data Protection Regulation ("GDPR").

1.    Data Controller

The administrator of the Users' data is Intersnack Poland Sp. z o.o. with its registered office in Niedźwiedzi 64, 32-090 Słomniki, KRS 0000262998, NIP 527-25-27-149, REGON 160106496 (the "Administrator").

2.    Data about Users

In connection with the use of the Website by the Users, the Administrator collects data that concern them, including personal data. These are data provided by the Users themselves (in the contact form/e-mail, in the recruitment form) and other data collected automatically on the Website by means of cookies and other similar technologies (e.g. IP address, information about the User's end device). More information on cookies used on the Website can be found here.  Providing personal data by the User is voluntary, but may be necessary in order for the User to use some of the functionalities available on the Website. 

3.    Purposes and legal bases of data processing 

Users' personal data are processed by the Administrator for the purpose of: 
•    providing the service of making the Website available by electronic means – such processing is necessary for the performance of the contract to which the User is a party (Article 6(1)(b) of the GDPR);
•    answering the question asked by the User in the contact form or e-mail – the basis for this processing is the legitimate interest of the Administrator, which is the possibility of handling the received inquiry (Article 6(1)(f) of the GDPR);
•    verification of the legitimacy of the complaint submitted by the User in the contact form/e-mail and satisfaction of their requests – such processing is necessary for the performance of the contract to which the User is a party (Article 6(1)(b) of the GDPR), as well as necessary to fulfil the Controller's obligation under civil or consumer law (Article 6(1)(c) of the GDPR); 
•    fulfilment of other legal requirements, related to e.g. control activities of state authorities – such processing is necessary to comply with legal obligations to which the Controller is subject (Article 6(1)(c) of the GDPR);
•    establishing and pursuing the Controller's claims or defending against claims against the Controller – the legal basis for this processing is the legitimate interest of the Controller, consisting in the possibility of using legal remedies (Article 6(1)(f) of the GDPR);
•    analytical and statistical – the basis for this processing is the legitimate interest of the Administrator, which is the possibility of analyzing traffic on the Website in order to improve its quality.
To the extent that the Website enables Users to participate in recruitment processes conducted by the Administrator, the personal data of Users-job candidates will be processed in order to carry out the recruitment process with their participation. The legal basis for such processing is the provisions of the Labour Code (Article 221§ 1 points 1-3 of the Labour Code in conjunction with Article 6 (1) (c) of the GDPR and Article 221 § 1 points 4-6 of the Labour Code in conjunction with Article 6 (1) (b) of the GDPR), and to the extent that the provisions of the Labour Code do not apply - the User's consent to the processing of their data for the above purpose (Article 6 (1) (a) of the GDPR and Article 9 (1) of the GDPR). Article 2(a) of the GDPR). In addition, the Administrator may, with the consent of the User-job candidate, also process their data in future recruitment processes (pursuant to Article 6(1)(a) of the GDPR).

4.    Data recipients and transfers outside the EEA

The recipients of Users' data may be:
•    service providers for the Administrator (e.g. providers of IT, hosting, legal services). In some cases, the provision of such services may involve the transfer of the User's data to a third country (i.e. outside the European Economic Area). We assure you that in such a situation, the transfer will take place to a country which, in accordance with the position of the European Commission, ensures an adequate level of protection of personal data or the entity to which the data will be transferred will provide appropriate safeguards, enforceable rights of data subjects and effective legal remedies;
•    competent state authorities or authorized third parties when they make a legitimate request for access to certain User data.

5.    Data retention period

Users' data will be stored for the time necessary to achieve the purposes of processing referred to in this Policy. At the same time, we would like to point out that the personal data provided by the User in connection with the complaint may be stored no later than until the end of the year in which the period of 3 years from the submission of the complaint expires. The personal data of the User-job candidate who took part in the recruitment process conducted by the Administrator and agreed to participate in future recruitment processes will be stored for a period of 12 months from the date of consent.

6.    Your rights

The User, in relation to the processing of their personal data by the Administrator, has the following rights: access to data, rectification of data, deletion of data, restriction of data processing, transfer of data, objection to processing (when the processing is carried out on the basis of the legitimate interest of the Administrator), withdrawal of consent to processing at any time (when the processing is carried out on the basis of the User's consent), whereby withdrawal of consent does not affect the lawfulness of the processing that was carried out on the basis of consent before its withdrawal, lodging a complaint with the President of the Office for Personal Data Protection.
